Makati City prosecutors dismiss Jasmine Curtis-Smith’s complaint against lawyer Ferdinand Topacio over allegations that his remarks online and in a radio program amounted to cyberlibel, unjust vexation, and gender-based online sexual harassment. According to the Office of the City of Prosecutor of Makati, the case is dismissed due to lack of prima facie evidence. The complaint stems from Topacio’s comments after Curtis-Smith spoke publicly against Quezon City Rep. Bong Suntay, who had made lewd remarks involving her sister, Anne Curtis. In his March radio program, Topacio allegedly questioned Curtis-Smith’s social media posting of bikini photos, making statements that prompted the complaint for gender-based online sexual harassment and related offenses. Multiple outlets report that prosecutors reviewed the allegations and determined that the evidence presented did not meet the threshold required to proceed. The dismissal means prosecutors do not move forward with the complaint at this stage, as the complainant’s allegations are not supported by sufficient evidence to establish a prima facie case.
