Enoch Burke has been granted permission by the High Court to challenge an earlier, unsuccessful employment-related appeal. The former teacher at Wilson’s Hospital School in Co Westmeath, who was suspended and then dismissed following concerns about his conduct toward the then-principal, Niamh McShane, is now seeking judicial review.
According to reports, the High Court decision, made on Tuesday, allows Burke to bring judicial review proceedings against three members of the Disciplinary Appeal Panel (DAP) as well as the Minister for Education and the Board of Management of Wilson’s Hospital School. The underlying disciplinary matter relates to conduct at a school religious event in June 2022.
The sources agree that Burke’s appeal did not succeed previously, leading to the current application. The decision at this stage does not determine the outcome of the judicial review, but it permits the legal challenge to proceed in court. The case therefore moves from the permission stage to further consideration of the issues raised in the judicial review application.
