An Obama-appointed federal judge issues a new temporary stay that blocks the Trump administration’s effort to terminate Temporary Protected Status (TPS) for people from Somalia, according to reports. The ruling is made by U.S. District Judge Allison Burroughs, who previously halted TPS changes and again prevents the administration from moving forward with termination while the legal challenge continues.
In the case, plaintiffs argue that ending Somalia TPS violates constitutional protections, including alleged due process and equal protection concerns under the Fifth Amendment. The judge’s order keeps TPS in place during the proceedings, creating another delay for the administration’s immigration agenda related to TPS.
The administration’s broader TPS policy is therefore met with another judicial setback, as courts continue to review the legality of the attempted termination. Further proceedings in the lawsuit determine whether the administration can proceed with ending TPS or whether the protections remain extended beyond the current stay.
