A woman is suing the New York Yankees for $10 million after she alleges a baseball bat flew into the stands and struck her head during a June 2 home game at Yankee Stadium. Multiple outlets report that the plaintiff, Stephanie Duluc, 37, a healthcare executive, was seated behind home plate in the luxury area when the incident occurred. Duluc alleges she suffered serious injuries, including a traumatic brain injury, and claims the injuries are permanent.
According to the complaint described by several outlets, Duluc says the protective netting in the area was not properly positioned for her section. Yahoo Sports and Fox News report that the suit alleges the netting near the on-deck circle was “significantly lower” than adjacent sections, creating an “unprotected opening” through which the bat entered. ABC News similarly describes the lawsuit as claiming the ball or bat flew toward the stands and over protective netting.
The Yankees have not been described in these reports as admitting fault. The case centers on the circumstances of the bat entering the stands and whether protective measures in that seating area were adequate.
