The Income Tax Department is preparing rules that will allow taxpayers to apply online for certificates authorising tax deduction at source (TDS) at a lower or nil rate, Parliament is told. Finance Minister of State Pankaj Chaudhary says the enabling rule is under preparation and will be notified later.
The update is linked to provisions in the Income-tax Act and recent finance legislation. Section 395(1) of the Income-tax Act, 2025 enables issuance of lower or nil TDS certificates. The Finance Act, 2026 adds an online application option intended to reduce compliance burden, particularly for small taxpayers. Once the rules are notified, payees will seek the certificate electronically.
Outlets also note that applications will be processed using information already available on the income-tax portal, including the Annual Information Statement (AIS), Taxpayer Information Summary (TIS) and Form 26AS. Certificates can be approved or rejected depending on whether the taxpayer meets prescribed conditions. The proposed online route is expected to cut paperwork and repeated visits, and help reduce excess TDS and subsequent refund delays, depending on eligibility and outcomes.
