Austria’s financial regulator, the FMA, fines crypto exchange Bitpanda €70,000 in what it describes as the country’s first published enforcement action under the EU’s Markets in Crypto-Assets (MiCA) rules. The regulator says the decision is now final and was issued for issues related to Bitpanda’s crypto asset white paper and marketing-related disclosures.
According to the regulator, Bitpanda breaches MiCA requirements in how it handles disclosures in both its white paper and marketing communications. CoinDesk reports specific compliance shortcomings: the firm did not submit a mandatory white paper at least 20 days before publication and also omitted required information in marketing materials. Cointelegraph similarly states that the fine is tied to breaches involving crypto white papers and marketing communications, but focuses more generally on the regulatory basis rather than the detailed timeline.
The enforcement action highlights early national application of MiCA obligations around pre-publication review and disclosure standards for crypto-related information provided to customers.
