The Trump administration’s Justice Department asks a federal appeals court to reinstate criminal human smuggling charges against Kilmar Ábrego García, whose case was dismissed in May. A district judge ruled the prosecution was “vindictive,” stating that officials brought the case after Ábrego García challenged his wrongful deportation to El Salvador.

In its filing to the US Court of Appeals for the Sixth Circuit, the DOJ argues the charges are based on evidence and law and are not retaliation. The government says it believed Ábrego García committed human smuggling and also that he posed a public threat, including claims tied to alleged MS-13 involvement, and it frames the district court’s reasoning as an improper intrusion into prosecutorial authority.

Ábrego García’s attorneys argue the DOJ’s appeal is “flat wrong.” They contend he was wrongly deported and returned to the United States after an administrative error was acknowledged, and they dispute allegations that he was affiliated with MS-13. The outlets describe the procedural timeline differently in emphasis, but both report the May dismissal for alleged vindictiveness and the DOJ’s June appeal seeking reinstatement.
