The Allahabad High Court, sitting in Lucknow, rules that government authorities cannot force private landowners to execute sale deeds for land acquisition. The court says land can be purchased through a sale deed only if the owner voluntarily agrees to sell and the parties mutually agree on the sale price. If such consent is not forthcoming, the state must follow the statutory acquisition process rather than pressuring owners to sign sale documents.

In its order, the court directs authorities not to harass the petitioners or forcibly obtain their consent for executing sale deeds. The bench also clarifies that voluntary sale and compulsory acquisition are legally distinct processes. The case concerns acquisition of land in Devipatan Tulsipur village of Balrampur district for road widening.

According to the state, it had already purchased about 80% of the required land through sale deeds, with roughly 104 registrations completed, but it had not been able to contact the petitioners or obtain their consent. The petitioners contend they do not want to sell and allege the authorities were pressuring them to agree to an unacceptable rate. The court notes that, absent agreement, the government should issue a notification under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and proceed accordingly.
