The U.S. Commodity Futures Trading Commission (CFTC) asks a judge to dismiss a lawsuit filed by CME Group challenging the regulator’s approach to crypto perpetual futures. In its motion, the CFTC argues that the case should not proceed and frames the dispute as “much ado about nothing.”
The regulator says CME lacks standing to bring the complaint, particularly regarding claims of competitive injury. The CFTC also points to the relevant regulatory order, stating that it allows any designated contract market—including CME—to list crypto perpetual futures. Under that view, CME’s ability to offer the products removes the basis for its arguments about harm.
While CME’s suit disputes the CFTC’s handling of perpetual futures, the CFTC’s filing emphasizes that the existing framework already permits listing by properly registered contract markets. Both outlets describe the motion as an effort to end the litigation at an early stage, without addressing the merits of CME’s underlying challenge.
