A U.S. federal judge in Boston has struck down President Donald Trump’s proposed $100,000 fee for new H-1B visa applications for highly skilled foreign workers, ruling it is an unlawful tax that Congress did not authorize. The decision was issued by U.S. District Judge Leo Sorokin in a case brought by 20 Democratic state attorneys general. The attorneys general challenged a fee Trump announced in September that would dramatically increase the cost of obtaining H-1B visas, a major pathway used by employers including technology companies, hospitals and universities.

Several outlets report that the court ordered the fee to be suspended and that the ruling vacates the fee. One report also states the judge found the action violated the federal Administrative Procedure Act and the Constitution, particularly on the grounds that Congress had not delegated authority to impose such a charge. The ruling therefore blocks the fee from being implemented while the underlying H-1B program continues under existing rules.
