A federal judge rules that Decarlos Brown Jr., accused of fatally stabbing Ukrainian refugee Iryna Zarutska on a Charlotte light-rail train, is incompetent to stand trial “at this time,” according to multiple outlets. The U.S. attorney’s office for the Western District of North Carolina says Brown will remain in custody while he receives mental health treatment through the remainder of the case. The ruling is in line with prior findings by mental health experts that he cannot currently participate in trial proceedings.

The court orders Brown committed to a federal treatment facility for up to four months, with the case to be reconsidered after that period to determine whether he regains competency. If he is found competent, the murder case would proceed. If he is not found competent, the court would address further treatment options, based on the legal process for restoring competency.

Brown faces federal charges related to violence against a railroad carrier and mass transportation system resulting in death. Prosecutors say he could face the death penalty if convicted.
