The “Law on Fair Representation” is scheduled for first reading before members of Parliament in a plenary session, with the stated aim of ensuring that state bodies and public enterprises comply with constitutional principles for employment across different ethnic communities. According to the proposal, the mechanism of fair representation is meant to replace the “balancer” previously abolished by the Constitutional Court. The draft law provides that representation in institutions should be based on real data from the most recent census and on specific employment needs.
Opposition lawmakers from the Albanian bloc argue that the proposed law is not a suitable substitute for the abolished balancer. The SDSM party has not yet publicly taken a clear position on whether it supports or opposes the draft, but it has raised remarks during the committee discussion. The proposal is also expected to be considered under a “small Badinter” procedure, which would require approval with a majority of the present MPs belonging to non-majority communities.
Before the plenary debate, a public hearing is planned within the Parliament’s Committee on Political System.
