West Bengal chief minister and BJP leader Suvendu Adhikari’s victory in the Bhabanipur Assembly constituency is being challenged in court after Trinamool Congress (TMC) leader Mamata Banerjee filed an election petition before the Calcutta High Court. Banerjee lost the seat she previously held by a margin of about 15,105 votes, according to reports. The petition contests Adhikari’s win and seeks judicial scrutiny of the outcome.

The High Court, presided over by Justice Gaurang Kanth, finds at the initial stage that the petition prima facie meets the requirements under the Representation of the People Act and does not warrant dismissal immediately. The court directed Adhikari to file a reply through affidavits within four weeks, followed by a rejoinder within the next four weeks, and fixed the matter for hearing after 12 weeks.

The court has also ordered preservation of CCTV footage from the counting centre and retention of related election materials, including EVMs and VVPAT units used across Bhabanipur polling stations, pending further proceedings. Banerjee’s allegations include claims of irregularities during counting, including issues raised about CCTV functioning and the handling of election agents, and other related objections cited in the petition.
