Nigeria’s Court of Appeal in Abuja orders a stay of execution on a Federal High Court judgment that had ordered the deregistration of five political parties, including the African Democratic Congress (ADC). Multiple reports say the appellate court, in a ruling delivered on Tuesday by a three-member panel led by Abba Mohammed, suspends the effect of the Monday decision by Justice Peter Lifu. The appellate panel holds that the federal high court proceeded in a manner that disregards an earlier directive from the Court of Appeal.
The stay affects the ADC and four other parties: Action Democratic Congress (ADC), Action Peoples Party (APP), Action Alliance (AA), Accord Party (AP) and Zenith Labour Party (ZLP). The Federal High Court had ordered the Independent National Electoral Commission (INEC) to deregister the parties and had also restrained INEC from recognizing them, accepting their nominations, or allowing them to participate in the 2027 general election, citing failure to meet constitutional requirements.
Atiku Abubakar, who is associated with the ADC, publicly welcomes the appellate decision and calls for adherence to the constitution and the rule of law. Reports also indicate that INEC played a role in moving the application for the stay.
