India’s food regulator FSSAI issues notices to six beverage companies over alleged misbranding and misleading claims on energy drinks. The notices cover Red Bull Energy Drink, PepsiCo’s Adrenaline Rush Energy Drink, Reliance Consumer Products’ Campa Energy Drink (Gold Boost), Sting Energy Drink, Hell Energy, and Monster Energy. FSSAI says it has not notified any standard for products described as “Energy Drink” or similar categories. The regulator also states that the Food Category System under the FSS Regulations is not meant for naming or labeling products, and that the brands market the products using descriptors such as “energy drink” on product branding and labeling. FSSAI further highlights that functional or therapeutic claims—such as statements about vitalizing the body and mind, enhancing focus, boosting energy levels, aiding general weakness, or similar conditions—are not permitted for food products under the Food Safety and Standards Act, 2006 and the associated rules and regulations. The regulator cites its broader compliance actions against misbranding and misleading advertising, including notices issued following consumer complaints, and says it informs consumers through social media about such actions.
