A Federal High Court in Abuja has struck out a suit filed by Nkemakolam Ukandu, the national welfare secretary of the African Democratic Congress (ADC), against Chief Judge John Tsoho and another judge, Peter Lifu. The court dismisses the case for lack of diligent prosecution after Ukandu and his lawyer fail to appear. Presiding Judge Salim Ibrahim makes the decision on Monday and orders Ukandu to pay costs to the judges.

According to reports, the court directs Ukandu to pay N50 million to Tsoho and N50 million to Lifu, totalling N100 million, within 14 days. The ruling is made under Order 19(1) of the Federal High Court Rules of 2019, following an oral application by counsel for the judges.

Ukandu’s suit had challenged Tsoho and Lifu, alleging bias and disobedience to a court order, and sought an order compelling the National Judicial Council (NJC) to investigate allegations of corruption, abuse of judicial powers and bias. The underlying dispute is linked to ADC leadership disagreements, including the reassignment of a case involving a leadership challenge.
