Irish Rail is suing Tipperary County Council after it is ordered to remove a signal mast located next to the old Cahir Rail Station, which is protected. Irish Rail argues that the mast is approximately 130 metres from the protected structure and therefore does not undermine the protection requirements. The company also says it has installed around 700 similar masts across the State without receiving comparable complaints or enforcement action.
The dispute centers on how the mast’s location and visual or operational impact are assessed in relation to the protected site. Tipperary County Council’s order to remove the mast is challenged by Irish Rail, which seeks to overturn or prevent the removal while the matter is before the courts.
The two reports agree on the basic facts of the case: Irish Rail initiates legal action against the council; the mast is associated with railway signalling near the old Cahir Station; and Irish Rail maintains the distance from the protected structure is substantial and that similar infrastructure has previously been accepted elsewhere.
