The Supreme Court has set aside 27 rulings by the Guwahati High Court related to Foreigners Tribunals in Assam that had upheld orders declaring certain individuals as foreigners. A bench of Justices Vikram Nath and Sandeep Mehta holds that the citizenship determination process must be fair, lawful, and reasonable, and that such declarations are not sustainable when the procedure is mechanical, one-sided, or without due application of mind.
The court remands the 27 cases back to the respective tribunals for fresh adjudication. It instructs that the tribunals must hear the matters again independently, based only on the evidence on record, and without being influenced by any previous observations or findings by the High Court or the tribunals.
The Supreme Court also clarifies that it is not examining the merits of the individuals’ citizenship claims in this stage. It reaffirms that the statutory burden of proof under Section 9 of the Foreigners Act, 1946 remains unchanged, requiring the person concerned to establish Indian citizenship.
Pending the new hearings, the court orders that coercive actions, including detention or deportation, should not be taken against the petitioners.
