Legborsi Nwiabu, an aspirant of the African Democratic Congress (ADC) for the Rivers State House of Assembly seat (Khana Constituency I), is suing the ADC, the party’s declared candidate Bright Nulee, and the Independent National Electoral Commission (INEC). The suit is filed at the Federal High Court in Port Harcourt, and it is linked to Nwiabu’s allegation that he was unlawfully excluded from the party’s primary election process.

In court, ADC counsel told the judge that the party had constituted a committee to address disputes arising from the primary election and sought permission for an out-of-court settlement. Counsel for the other parties did not oppose the request, but Nwiabu’s lawyer, Felix Beragbara, objected, saying Nwiabu was not informed about any such committee. Justice Muhammed Turaki granted leave to explore settlement and adjourned the case to August 12, 2026, either for a report on the outcome or for further hearing.

Beragbara says the primaries were scheduled for May 21, 2026, but were allegedly moved to May 22. He adds that Nwiabu and his agents were at voting centres across the 11 wards, but no ADC officials or INEC monitoring officers appeared to conduct the election. Nwiabu later petitioned the party’s appeals committee, and when the petition was allegedly ignored, the party declared Bright Nulee and forwarded his name to INEC.
