ADC leadership suit against David Mark, Aregbesola resumes in Abuja court

The Federal High Court in Abuja will on Monday, September 14, resume hearing in the legal battle challenging the leadership of the African Democratic Congress (ADC) under Senator David Mark and Rauf Aregbesola.Justice Peter Odo Lifu is expected to preside over the case, which was filed by former ADC Deputy National Chairman, Nafiu Bala Gombe, and two others. The plaintiffs are seeking an order restraining Mark, Aregbesola, and their allies from parading themselves as party leaders, alleging their emergence violated the ADC constitution and the Electoral Act.The court had earlier fined Mark, Aregbesola, and the ADC a total of ₦3 million for filing 27 separate motions deemed frivolous and aimed at delaying proceedings. Each was ordered to pay ₦1 million to the plaintiffs as compensation.Justice Lifu also rejected attempts by members of the ADC National Working Committee to join the suit, ruling that their interests would be determined in the decision against Mark and Aregbesola, who were sued as National Chairman and National Secretary.According to the hearing notice, parties are expected to adopt their briefs of argument on September 14, after which a date for final judgment will be fixed.The case, which also lists the Independent National Electoral Commission (INEC) and former ADC Chairman Ralph Nwosu as defendants, is seen as pivotal in determining the legitimacy of the party’s current leadership.
