The Food Safety and Standards Authority of India (FSSAI) initiates legal action against Nestle India concerning alleged violations connected to infant nutrition products. Outlets report that FSSAI files adjudication cases relating to three products and seeks clarifications from the company over certain statements used in relation to the products.
According to FSSAI, its assessment covers both promotional material and product-related claims available through e-commerce and other marketing. Specifically, FSSAI flags claims such as “5 HMOs” and “Whey Protein” for NAN Excella Pro Stage 1, and a “Whey Protein” claim about being easy to digest for Lactogen Pro 1. The regulator also invokes restrictions that limit promotional content intended to increase the saleability of infant foods and requirements under relevant food safety and advertising provisions.
Separately, one report adds that FSSAI tests a follow-up formula sample from Nestle India and says it finds the sample below the prescribed biotin level, including confirmation by a referral laboratory. Following the development, one outlet reports a market reaction, with Nestle shares falling more than 2% on September 18.
