Mohan Rocky Springwater Pvt. Ltd, the maker of Old Monk, tells the Bombay High Court that restrictions on the sale of its rum from its Khopoli unit in Maharashtra are causing losses exceeding Rs 500 crore for the company and about Rs 350 crore in excise revenue for the state. The company challenges a prohibition order linked to how the product is formulated and labelled, and the court has refused interim relief.

The dispute centres on the Food Safety and Standards Authority of India (FSSAI), which argues that the spirit cannot be marketed simply as “rum” if it uses added rum flavouring. FSSAI says the product description must reflect its composition and seeks a “rum-like” label, along with clearer disclosure about added flavour. The manufacturer also contends that the same formulation continues to be sold from other Maharashtra units without similar restrictions.

The matter is scheduled to be heard again by a division bench on October 23. Outlets report that authorities indicate sales may be allowed if the company agrees to change the product description as requested by FSSAI, after the regulator did not approve revised labels submitted by the company.
