The Delhi High Court is hearing a suit filed by Indian cricketer Abhishek Sharma over alleged unauthorised online use and AI-based alteration of his name, image, and likeness. During the proceedings, Justice Jyoti Singh examined the boundaries between personality rights and defamation in the context of digital content, including AI-generated or manipulated images. The court considered web links Sharma identified as infringing his personality rights. Meta’s counsel informed the court that, among eight URLs under consideration, two were no longer accessible, and argued that one remaining post appeared to be “paparazzi kind of” material and did not amount to a violation of personality rights. Sharma’s counsel disputed this, saying the challenged content involves an original image allegedly altered through AI by changing appearance and context, creating a misleading depiction.

The court observed that online disputes often involve a “thin line” between defamation and personality rights, noting some overlap and that defamatory content may also raise personality-rights concerns. The case was adjourned for further hearing on July 9, with the court indicating that issues relating to the plaint require attention.
